P/16/121 Dear Ms Walton, I note there has been four letters of objection lodged on the council website. There are items relating to planning policy or legal matters which I feel it would be appropriate to respond on behalf of my clients. However I need to point out that Mr and Mrs Thomas are away for a significant part of the winter in Spain, my clients have not been able to correspond with them following our site meeting as they have no contact details. In any event, I am pleased they and others have had the opportunity to view the proposals via the internet, and make their comments. We have had a meeting with your self, and it was agreed that there had been a significant reduction in the size of the scheme, having taken into account the comments submitted on the previous application. These changes are significant, particularly taking into account the removal of the external staircase and the reduction in the extension itself. I make this point because the staircase was a major cause for concern. The two together would take the total building and stairs to the boundary of the property. Therefore, the overall reduction on the new scheme is in reality 50%, 2.5m. My client was pleased you considered that these changes were significant, and bearing in mind the precedent set in the past with all the large extensions in the vicinity, the new proposals would not cause a significant impact bearing in mind other extensions. On that basis, my clients instructed me to submit these new proposals following our meeting, on the basis that you indicated you might be able to support the application following receipt of the new details. Those details followed the sketches given to you at our meeting. One very important aspect of this applications is to address the current privacy impact to my client's property, which I believe you witnessed for yourself at our meeting. My client's eldest child's bedroom will now have a ground floor side window, rather than a window on the rear of the property viewed by numerous properties opposite. We have already agreed that the front elevations have been significantly improved on the new proposals, including the juliet's balcony. This was not discussed further at our meeting because we generally agreed that there is no architectural historical context or merit in Porthcressa Road, and the proposals can only improve upon what currently exists. Neither will these changes to the front elevation cause any loss of light to either of the neighbours. There is a manhole in the garage, and it will be replaced with a triple seal unit. Access for maintenance will be available, if necessary, inside the room. Whilst not a planning matter, it may raise comment by members. I would like to make it clear that Mr and Mrs Thomas are wrong when they say they have the ability to stop builders going down the passageway between Auriga and Roanoke. The legal position is absolutely clear; there is a right of way for any purpose for the benefit of not just Roanoke, but also Shearwater and Trevessa. This does not stipulate any particular use, so if planning permission were granted, then my clients contractor will be able to use this right of way. Any work carried out on the boundary of an adjoining property will be covered under the Party Wall Act.
