Introduction
For Licensable HMO's, the Prescribed standards for deciding the suitability for occupation of an HMO by a particular maximum number of households or persons as set out in “SCHEDULE 3” of the above Regulation. The room sizes and amenities will dictate the number of occupiers allowed within the terms of the Licence. Where these standards are not present it is unlikely a Licence may be issued. A condition within a Licence could require installation of the mandatory facilities and would need to be met within a given time frame. That decision is entirely discretionary and a Licence holder can be prosecuted for failing to adhere to licence conditions.
The standards are mandatory under the Legislation: As we are a collaborative Council with Cornwall Council, use this document as a concise introductory guide to achieving the mandatory standards. This should be read in conjunction with the Legislation.
