Traffic Regulation Order (TRO)

Traffic Regulation Orders are legal documents which support a range of measures to govern or restrict the use of public roads, such as yellow lines and one-way streets. TROs are put in place to help support the health, safety and wellbeing of both pedestrians and drivers ensuring access is possible at all times, this is particularly important for our emergency services.

Please think about other users of the highway before you park your vehicle:-

  • Are you blocking access for other vehicles or pedestrians?
  • Is it necessary to park your vehicle in an area that could cause an obstruction to other highway users?
  • Can you park in an area or location that will not obstruct the highway?
  • Think about larger vehicles like the Emergency Services, lorries and buses that require longer and wider access

Parking on the Street

You should not park if there is a TRO applied to the area, examples include:

  • Double yellow lines
  • Single yellow lines
  • Loading bays
  • Bus Stops
  • Restricted and residential zones

 

Any vehicle can be issued a penalty notice if:

  • It is causing a safety issue or
  • Blocking the road or pavement

When are vehicles permitted to park in areas with a TRO?

Vehicles are permitted to wait on the sides and lengths of the roads above for as long as necessary in the following circumstances:

1. To enable a person to board or alight from the vehicle

2. To enable goods to be loaded onto or unloaded from the vehicle

3. To enable the vehicle, if it is in the service of or employed by the Post Office, to be used for the purpose of delivering or collecting postal packets as defined in Section 87 of the Post Office Act 1953

4. To enable the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of the length of road so referred to or the laying, erection, alteration or repair in or near to the said length of road of any sewer or of any main, pipe, cable or apparatus for the provision of gas, water, electricity or telecommunications;

5. To enable the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in pursuance of statutory powers and duties; or

6. To enable the vehicle to take in fuel, oil, water or air from any garage situated on or adjacent to the said length of road

7. The vehicle is being used for police, fire brigade or ambulance purposes

8. A vehicle when the person in control of the vehicle -

  • Is required by law to stop
  • Is obliged to stop in order to avoid an accident; or
  • Is prevented from proceeding by circumstances outside his control

9. The vehicle is owned by a funeral director or owner of funeral vehicles when in use as part of a funeral cortege or otherwise in connection with a funeral; or

10. To any hackney carriage while waiting at a duly authorised cab rank.

11. The vehicle displays in the relevant position a disabled person's badge, and a parking disc (on which the driver, or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait in the lengths of road referred to in the Article for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from a previous period of waiting by the same vehicle in the same length of road).

Enforcement

The Isles of Scilly is not designated as a Civil Enforcement Area for the purposes of enforcing parking contraventions, so the Council is not able to carry out enforcement activity.

The police have powers to enforce in any area where a TRO is in place and may do so on the Isles of Scilly if they become aware of a contravention.
